Once a Delaware LLC has its Certificate of Formation stamped and approved by the state of Delaware, the next step is to obtain a Federal Tax ID Number, also known as an EIN, from the IRS. Please note that this not a Delaware Tax ID (from the state), but rather a federal number. You do not need to apply for a separate Tax ID from the state of Delaware itself.
An SS-4 form should be completed and submitted to the IRS in order to generate the Federal Tax ID number. When applying for the EIN, you will be required to answer a number of questions in order to complete the SS-4 application.

Thus for us the incorporation was a waste of money because our major objective was to facilitate payments for goods to our clients in the USA who seem to be paypal users

The second type of individual tax number is the ITIN number. The term “ITIN” stands for Individual Taxpayer Identification Number. Any person who needs a tax identification number but is not eligible to obtain a Social Security Number can apply for an ITIN. Many of our non US clients use this ITIN when applying for the bank account, accounts with Paypal or other online merchants.

Hi If a Delaware LLC is owned by a persons who are not US citizens and live in EU and if the LLC doesn't have any employees and doesn't do any business in US, does it have to get a Tax ID number? Best regards

All U.S. companies are required to have an EIN to open a U.S. bank account, obtain loans, hire employees or if there is a tax or reporting requirement to the U.S. Government for the entity. We have found that many non-U.S. banks are now requiring the company to have an EIN number to open the bank account.
